(Revocation of Permission and Others)
Article 48. The Minister of Transport may revoke permission for the establishment of aerodromes or air navigation facilities, or may order deactivation of the whole or part of the aerodrome for a certain period in the cases described hereunder. However, in the case of subparagraph 2 through 5 below, the Minister of Transport may revoke permission for establishment only when the aerodrome provider or the air navigation facility provider does not obey the order within the specified period in which the Minister of Transport has ordered the aerodrome provider or the air navigation facility provider to take the necessary steps to make those facilities conform to the plan described in the application or to the technical standards under Article 39 paragraph 1 subparagraph 1, or to administer those facilities concerned in accordance with the technical standards under the preceding Article paragraph 1.

 

(1)If the works are not completed by the scheduled date of completion stipulated under Article 41 paragraph 1 (a revised date, in the case in which altering the predetermined scheduled date is effected under the provisions of die same Article paragraph 2) in the absence of mitigating circumstances;
(2)if as a result of an inspection under Article 42 paragraph 1 (including the case according to Article 43 paragraph 2) the facilities are recognized to be Out of compliance with the establishment or alteration plan;
(3)If as a result of an inspection under Article 42 paragraph 1 which apply accordingly to Article 44 paragraph 5 or Article 45 paragraph 2 the facilities concerned are recognized to be out of compliance with the plan described in the application concerning these facilities;
(4)If the administration of the aerodrome or the air navigation facility is not in accordance with the technical standards stipulated under the preceding Article paragraph 1;
(5)If the location and the structures etc. of the aerodrome fail to conform to the standards stipulated under Article 39 paragraph 1 item 1;
(6)if the conditions governing the permission have been violated.

 

(Restriction of Structures, etc.)
Article 49. No person shall, after a notification issued under Article 40 concerning an aerodrome for public use (including when applied accordingly thereto under Article 43 paragraph 2) install, plant or leave any structures (except the part referring to the structures which are under construction at the time of notification), plants or any other objects which protrude above the approach surface, transitional surface or horizontal surface (the surface shall be the lowest one if surfaces overlap) described in the said notification. However, the same shall not apply where temporary structures and any other objects (except those relating to approach surfaces or transitional surfaces) specified in Ordinances of the Ministry of Transport are installed or are left under the approval of the
